Terms & Conditions of Sale

Prices: Prices are based on current market conditions and are subject to change without notice. All prices are F.O.B. Oak Brook Farms, Inc., Morrison, TN.

Terms: To those who have established credit with us, payment is Net 30 days from invoice date. Orders for shipment C.O.D. and all new accounts must be accompanied by a 30% deposit. All accounts over 30 days are subject to a service charge of 1.5% per month plus cost of collection.

Claims: Claims for any cause must be made promptly upon receipt of stock. We will not honor claims after goods have been accepted, or when a written report is not made within ten days after arrival.

Liability: We guarantee to ship good, healthy stock in accordance with ANLA standards, but we do not assume any responsibility after stock leaves the nursery. We give no warranty, expressed or implied, as to description or productiveness, and will not in any way be responsible for results secured in transplanting this stock. We further assume no responsibility for damage to said stock from heat, cold, exposure or other causes after stock leaves our nursery. We shall in no case be liable for any sum greater than the amount originally received for said stock.

Transportation: We request our customers to give definite shipping instructions regarding manner in which they wish the stock shipped. In absence of instructions, we will use our best judgement, but without assuming responsibility. We have access to local trucks who will deliver your stock on a mileage basis at a reasonable price. Customers are responsible for unloading trucks upon arrival.

Transportation Risks: We pack our stock with the greatest of care, therefore, our responsibility ends upon delivery to the carrier. All stock travels at the risk and expense of purchaser.
